These Terms and Conditions govern access to and use of the JewelPatakha website and the purchase of products through JewelPatakha’s authorised online sales channels.

By visiting the website, creating an account, placing an order, making a payment or purchasing through JewelPatakha’s official Instagram or WhatsApp channels, the customer agrees to these Terms and Conditions and the policies incorporated into them.

Please read these Terms carefully before placing an order.


Important Terms at a Glance

  • JewelPatakha sells artificial and fashion jewellery within India.
  • Customers placing orders must be at least 18 years old or act under the supervision of a parent or lawful guardian.
  • Prices are displayed in Indian rupees and include applicable GST unless stated otherwise.
  • An automated order acknowledgement does not necessarily mean that an order has been finally accepted.
  • An order is ordinarily accepted when JewelPatakha dispatches it or expressly confirms acceptance in writing.
  • Cash on Delivery is subject to verification, PIN-code serviceability and an order-value limit.
  • Customised, altered, made-to-order, pre-order and specially sourced products may be subject to special cancellation and return restrictions.
  • Product colours, measurements, weight and hand-finished details may contain reasonable minor variations.
  • Customers must use the website and JewelPatakha’s content lawfully.
  • Nothing in these Terms limits a customer’s mandatory rights under applicable Indian consumer law.

The Information Technology Act, 2000 recognises contracts formed through electronic means, and electronic contracts are not unenforceable merely because electronic records were used in their formation.

JewelPatakha owns and maintains jewellery inventory sourced from manufacturers and wholesalers and sells products to customers within India.


2. Scope of These Terms

These Terms apply to orders placed through:

  • The JewelPatakha website;
  • JewelPatakha’s official Instagram account;
  • JewelPatakha’s official WhatsApp number;
  • Payment links or invoices issued directly by JewelPatakha; and
  • Other digital sales channels expressly identified as official by JewelPatakha.

Purchases made at exhibitions, pop-ups or physical selling locations may be governed by separate terms communicated at the point of purchase.

Where an exhibition order is later processed as an online order and JewelPatakha confirms that these Terms apply, the applicable written confirmation will determine the governing conditions.


3. Related Policies

The following policies form part of these Terms:

  1. Cancellation Policy;
  2. Shipping and Delivery Policy;
  3. Return, Exchange & Refund Policy;
  4. Product Disclaimer;
  5. Privacy Policy; and
  6. Grievance Redressal Policy.

Customers should read these documents before placing an order.

Where a product-specific condition conflicts with a general provision, the clearly disclosed product-specific condition will ordinarily apply to that product, subject to mandatory law.


4. Eligibility to Use the Website

A customer placing an order must:

  • Be at least 18 years old;
  • Have legal capacity to enter into a contract;
  • Provide accurate and complete information;
  • Use an authorised payment method; and
  • Purchase for a lawful purpose.

A person below 18 years may browse the website but should place an order only through a parent or lawful guardian.

The adult completing the transaction will be treated as responsible for the order and payment.


5. Customer Accounts and Guest Checkout

JewelPatakha may permit customers to:

  • Create a customer account;
  • Place an order through guest checkout; or
  • Purchase through Instagram or WhatsApp.

Customers creating an account must:

  1. Provide accurate information;
  2. Keep login credentials confidential;
  3. Prevent unauthorised access;
  4. Update outdated contact details; and
  5. Inform JewelPatakha promptly of suspected misuse.

The customer is responsible for activity conducted through their account to the extent permitted by law, except where unauthorised activity results from JewelPatakha’s failure to maintain reasonable security.


6. Accuracy of Customer Information

Customers must provide accurate information including:

  • Full name;
  • Email address;
  • Mobile number;
  • Billing address;
  • Shipping address;
  • PIN code;
  • Recipient details; and
  • GST details where a business invoice is requested.

JewelPatakha is not responsible for avoidable delay or failed delivery caused by materially incorrect or incomplete information supplied by the customer.

The customer should review the order confirmation immediately and notify JewelPatakha of any error before dispatch.


7. Product Nature

Unless expressly stated otherwise, products sold by JewelPatakha are artificial or fashion jewellery.

Products may include:

  • Brass;
  • Copper-based or mixed-metal alloys;
  • Gold-tone or antique-gold plating;
  • Imitation Kundan;
  • Polki-style stones;
  • American Diamond or diamond-look stones;
  • Glass or synthetic stones;
  • Imitation pearls;
  • Beads;
  • Thread;
  • Resin; and
  • Other decorative fashion-jewellery materials.

Terms such as “Kundan,” “Polki,” “antique,” “heritage,” “royal,” “Rajwadi” and “bridal” ordinarily describe the style, finish or design inspiration. They do not represent that the product contains real gold, natural diamonds or precious gemstones unless expressly stated and supported by appropriate documentation.

Customers should review the Product Disclaimer before ordering.


8. Product Images and Descriptions

JewelPatakha makes reasonable efforts to present product information accurately.

Product pages may contain:

  • Real product photographs;
  • Studio images;
  • Natural-light images;
  • Close-up images;
  • Model-worn images;
  • Lifestyle images;
  • Videos;
  • Digitally enhanced images; and
  • AI-assisted styling visualisations.

Product colours may appear slightly different because of:

  • Lighting;
  • Photography;
  • Image editing;
  • Screen calibration;
  • Device settings; and
  • Reflections from stones or metal.

Measurements and weights are approximate unless specifically identified as exact.

Hand-finished products may contain reasonable minor differences in stone placement, bead arrangement, texture, polish, colour tone or measurements.

A material difference affecting the product’s identity, advertised features or usability will be assessed under the Return, Exchange & Refund Policy and applicable consumer law.


9. Product Availability

All products are subject to availability.

A product may become unavailable because of:

  • Simultaneous customer orders;
  • Inventory mismatch;
  • Product damage;
  • Quality-check rejection;
  • Supplier failure;
  • Technical error; or
  • Restocking delay.

Adding a product to the cart or wishlist does not reserve it.

Where a paid product becomes unavailable, JewelPatakha may offer:

  • An alternative product;
  • Store credit with the customer’s consent; or
  • A refund for the unavailable product.

The customer is not required to accept a substitute or store credit where a monetary refund is otherwise due.


10. Prices and Taxes

Unless stated otherwise:

  • Prices are displayed in Indian rupees;
  • Prices include applicable GST;
  • Delivery and COD charges may be added separately;
  • Discounts are applied according to the applicable offer; and
  • The final payable amount will be shown or communicated before order confirmation.

Prices may change before an order is accepted.

A price change will not ordinarily affect an order already accepted by JewelPatakha, except where there is an obvious pricing or technical error and the customer is offered an opportunity to cancel.


11. Pricing and Technical Errors

JewelPatakha may correct genuine errors involving:

  • Product price;
  • Product description;
  • Tax;
  • Discount calculation;
  • Stock;
  • Shipping charge;
  • Product variation; or
  • Website functionality.

Where a material error is identified before dispatch, JewelPatakha may:

  1. Contact the customer;
  2. Provide the corrected information;
  3. Ask whether the customer wishes to continue;
  4. Offer an alternative product; or
  5. Cancel the affected order and issue an applicable refund.

JewelPatakha will not knowingly rely on an error to mislead a customer or deny a mandatory consumer remedy. The Consumer Protection Act, 2019 establishes protections against unfair trade practices and provides a framework for consumer dispute redressal. 


12. Placing an Order

An order may be placed through:

  • The website checkout;
  • An official WhatsApp conversation;
  • An official Instagram conversation followed by written confirmation;
  • A payment link;
  • A written quotation; or
  • An invoice issued by JewelPatakha.

Before placing an order, the customer should review:

  • Product name;
  • Product images;
  • Material information;
  • Included components;
  • Colour;
  • Measurements;
  • Approximate weight;
  • Price;
  • Delivery estimate;
  • Return eligibility; and
  • Product-specific restrictions.

The customer is responsible for ensuring that the selected product is suitable for their intended occasion and requirements.


13. Order Acknowledgement and Acceptance

After an order is submitted, JewelPatakha may send an automated acknowledgement or payment confirmation.

This acknowledgement confirms receipt of the order but does not necessarily mean that JewelPatakha has finally accepted it.

An order is ordinarily accepted when:

  • JewelPatakha dispatches the product; or
  • JewelPatakha expressly confirms acceptance in writing.

Before acceptance, JewelPatakha may verify:

  • Payment;
  • COD confirmation;
  • Product availability;
  • Product quality;
  • Delivery serviceability;
  • Customer information; and
  • Suspected fraud or misuse.

Electronic communications, acknowledgements and order confirmations may be retained as electronic records. The Information Technology Act recognises electronic records and electronically formed contracts. 


14. Order Rejection or Cancellation by JewelPatakha

JewelPatakha may reject or cancel an order before dispatch where reasonably necessary because of:

  • Product unavailability;
  • Quality-check failure;
  • Incorrect price or description;
  • Payment failure;
  • Suspected fraud;
  • COD verification failure;
  • Duplicate order;
  • Incorrect delivery information;
  • Courier unserviceability;
  • Legal or regulatory restriction;
  • Supplier failure;
  • Technical error; or
  • Force-majeure circumstances.

Where JewelPatakha cancels a prepaid order, it will initiate a full refund of the amount collected for the cancelled order.


15. Payment Methods

JewelPatakha may accept:

  • UPI;
  • Debit cards;
  • Credit cards;
  • Net banking;
  • Cash on Delivery; and
  • Other payment methods displayed at checkout or approved in writing.

Online payments are processed through Razorpay and participating banks, card networks or UPI providers.

JewelPatakha does not require customers to disclose:

  • UPI PINs;
  • Card PINs;
  • CVVs;
  • Banking passwords; or
  • Payment-authorisation OTPs.

Customers should not disclose such information to anyone claiming to represent JewelPatakha.


16. Payment Authorisation

By submitting payment, the customer confirms that:

  • They are authorised to use the payment method;
  • The payment information provided is accurate;
  • The transaction is lawful; and
  • Sufficient funds or credit are available.

An order may be placed on hold while payment is:

  • Pending;
  • Under review;
  • Disputed;
  • Reversed; or
  • Flagged for security verification.

JewelPatakha may request limited transaction information reasonably required to verify payment but will not request confidential authorisation credentials.


17. Failed, Pending or Duplicate Payments

Where a payment is shown as failed or pending, the customer should avoid immediately repeating the payment without checking the status.

If money is debited but no order is confirmed, JewelPatakha may verify whether the amount was received.

Where JewelPatakha receives a duplicate payment, the excess amount will be refunded after verification.

Where JewelPatakha did not receive the payment, reversal may be handled by the customer’s bank, Razorpay or the relevant payment provider.


18. Cash on Delivery

Cash on Delivery is subject to the following conditions:

JewelPatakha may restrict COD where there is evidence of:

  • Repeated refusal;
  • False orders;
  • Unreachable contact details;
  • Repeated Return-to-Origin shipments;
  • Fraud; or
  • Misuse of the service.

19. COD Verification

A COD order may be placed on hold until the customer verifies:

  • Name;
  • Telephone number;
  • Product;
  • Order value;
  • Delivery address; and
  • Intention to accept the parcel.

If the customer fails to respond within a reasonable period, JewelPatakha may cancel the order.

A COD order is not finally accepted merely because it has been submitted through the website.


20. Shipping and Delivery

JewelPatakha currently delivers within India.

Unless a product-specific timeline is stated:

  • In-stock orders are ordinarily processed within 2–3 business days;
  • Delivery ordinarily takes 3–10 business days after dispatch; and
  • Remote locations may require up to 12 business days after dispatch.

Delivery estimates are not guarantees of arrival before a wedding, festival, journey or other event unless JewelPatakha gives an express written guarantee for the order.

Shipping is governed by the Shipping and Delivery Policy.


21. Shipping Charges

The standard shipping structure is:

The ₹99 COD handling charge is separate from the standard shipping charge.

Promotional shipping offers may be introduced or withdrawn from time to time. The applicable amount will be displayed or communicated before the order is confirmed.


22. Delivery Address and Recipient

Delivery may be made to:

  • The customer;
  • The named recipient;
  • A family member;
  • Reception or security personnel;
  • An employee at the delivery address; or
  • Another person reasonably appearing authorised to accept the parcel.

Customers should ensure that the recipient and address details are accurate.

A delivery accepted by an authorised person at the supplied address will ordinarily be treated as valid delivery, subject to genuine claims concerning false delivery, concealed transit damage or deficiency in service.


23. Delivery Delays

Delivery may be delayed because of:

  • Weather;
  • Transport disruption;
  • Peak wedding or festive demand;
  • Remote-area service limitations;
  • Government restrictions;
  • Public disturbances;
  • Courier network interruption;
  • Incorrect customer information;
  • Force majeure; or
  • Other circumstances outside reasonable control.

JewelPatakha will make reasonable efforts to provide tracking assistance and an appropriate resolution where a parcel is confirmed lost or cannot be delivered.

Mandatory consumer rights relating to deficient service or qualifying delayed delivery remain unaffected. The Consumer Protection Act protects consumer interests and provides remedies through consumer dispute-redressal mechanisms. 


24. Order Cancellation

Standard in-stock orders may ordinarily be cancelled before dispatch.

Customers should preferably submit a cancellation request within six hours of placing the order, although a later request may still be considered if dispatch has not occurred.

Orders cannot ordinarily be cancelled after dispatch.

Customised, altered, made-to-order, pre-order and specially sourced products may become non-cancellable once:

  • The order is confirmed;
  • Alteration begins;
  • Procurement begins;
  • Supplier commitment is made; or
  • Non-recoverable costs are incurred.

Cancellation requests are governed by the Cancellation Policy.


25. Returns, Exchanges and Refunds

Eligible return or exchange requests must generally be submitted within five calendar days after delivery.

Visible transit damage, an incorrect product, a missing item or a tampered parcel should be reported within 48 hours of delivery.

Preference-based returns may qualify for:

  • One exchange; or
  • Store credit,

subject to eligibility and inspection.

Monetary refunds are ordinarily available where:

  • A defective product is confirmed;
  • A materially misdescribed product is supplied;
  • An incorrect product is delivered;
  • An eligible replacement is unavailable;
  • JewelPatakha cancels a paid order;
  • A parcel is confirmed lost; or
  • A refund is required by applicable law.

Returns are governed by the Return, Exchange & Refund Policy.


26. Non-Returnable Products

The following products are ordinarily not eligible for preference-based return or exchange:

  • Earrings;
  • Nose rings;
  • Other pierced jewellery;
  • Customised products;
  • Altered products;
  • Made-to-order products;
  • Pre-order products;
  • Specially sourced products;
  • Clearance or final-sale products;
  • Products purchased at exhibitions;
  • Products showing signs of use; and
  • Products damaged because of improper care.

These restrictions do not remove remedies for products that were defective, incorrectly supplied or materially misdescribed, or any right that cannot lawfully be excluded.


27. Product Inspection

Returned products may be inspected to determine:

  • Whether the correct product was returned;
  • Whether all components are included;
  • Whether tags and packaging are present;
  • Whether the product was worn;
  • Whether the reported defect exists;
  • Whether damage resulted from misuse; and
  • Whether the request meets the applicable policy.

A discretionary return may be rejected where the product is worn, altered, incomplete or damaged after delivery.


28. Refund Processing

Approved refunds will ordinarily be initiated within five business days after:

  • Cancellation approval; or
  • Receipt, inspection and approval of an eligible return.

Prepaid refunds will ordinarily be sent to the original payment method.

Approved COD refunds may be processed through UPI or bank transfer.

Banking, card-network and payment-provider processing times may apply after JewelPatakha initiates the refund.


29. Promotions and Coupon Codes

Promotional codes may be subject to conditions including:

  • Expiry dates;
  • Minimum order values;
  • Product exclusions;
  • One use per customer;
  • One code per order;
  • Limited availability;
  • Non-combination with other offers; and
  • No cash value.

A promotion may be withdrawn or modified before an order is accepted.

Where a product forming part of a promotional order is cancelled or returned, JewelPatakha may recalculate:

  • The remaining order value;
  • The discount;
  • Free-shipping eligibility;
  • Complimentary gifts; and
  • The eligible refund or store credit.

Promotions will not be administered in a manner intended to mislead customers or deny mandatory rights.


30. Complimentary Gifts

A complimentary gift:

  • Is subject to availability;
  • May be replaced with a comparable gift;
  • Is not ordinarily exchangeable for cash;
  • May need to be returned when the qualifying product is returned; and
  • May have its reasonable disclosed value deducted where it is not returned.

A defective complimentary item may be reviewed, but replacement will be subject to availability.


31. Gift Cards and Store Credit

Gift cards will be available only if JewelPatakha expressly launches them and publishes their applicable conditions.

Unless otherwise communicated, store credit:

  • Is valid for six months from issue;
  • Is redeemable only through JewelPatakha;
  • Cannot ordinarily be exchanged for cash;
  • May be used subject to product availability; and
  • Must not be transferred or resold without approval.

Store credit will not be forced upon a customer where a monetary refund is legally due.


32. Product Care

Customers should:

  • Keep jewellery away from water;
  • Avoid perfume, hairspray and chemicals;
  • Apply cosmetics before wearing jewellery;
  • Remove jewellery before sleeping, swimming or exercising;
  • Wipe jewellery after use;
  • Store pieces separately;
  • Avoid bending chains, hooks and stone settings; and
  • Follow product-specific care instructions.

Damage caused by improper use, impact, moisture, chemicals or storage will not ordinarily be treated as a manufacturing defect.


33. Intellectual Property

Unless otherwise stated, JewelPatakha owns or is authorised to use the website’s:

  • Brand name;
  • Logo;
  • JP monogram;
  • Product photographs;
  • Videos;
  • Product descriptions;
  • Website text;
  • Graphics;
  • Artwork;
  • Layout;
  • Packaging designs;
  • Promotional materials; and
  • Social-media content.

These materials are protected under applicable intellectual-property laws.

No content may be copied, reproduced, republished, sold, altered, scraped or commercially exploited without prior written permission.


34. Limited Personal Use

Customers may:

  • Browse the website;
  • Save product links;
  • Share official product links;
  • Take screenshots for personal shopping assistance; and
  • Share JewelPatakha’s official posts using platform-provided sharing tools.

Customers may not:

  • Remove the JewelPatakha name or watermark;
  • Present JewelPatakha images as their own;
  • Use images for another jewellery business;
  • Create unauthorised catalogues;
  • Run advertisements using JewelPatakha content;
  • Copy product descriptions for commercial use; or
  • Use JewelPatakha content to mislead customers.

35. Reviews and Customer Content

Customers may submit reviews, photographs, videos or testimonials where that feature is available.

By submitting content, the customer confirms that:

  • The content is genuine;
  • It relates to their experience;
  • They have the right to submit it;
  • It does not infringe another person’s rights;
  • It is not unlawful or misleading; and
  • It does not contain unnecessary confidential information.

JewelPatakha may moderate or remove content that is:

  • Fraudulent;
  • Irrelevant;
  • Abusive;
  • Discriminatory;
  • Infringing;
  • Promotional spam;
  • Unlawful; or
  • Contains personal or payment information.

A negative review will not be removed merely because it criticises JewelPatakha.


36. Use of Customer Photographs

JewelPatakha should obtain permission before using an identifiable customer photograph or video in:

  • Paid advertisements;
  • Website banners;
  • Promotional reels;
  • Social-media campaigns;
  • Printed material; or
  • Influencer promotions.

Permission may be withdrawn for future use by contacting JewelPatakha, subject to material already lawfully printed or published before the request.

Personal information and customer content will be handled under the Privacy Policy. India’s Digital Personal Data Protection framework recognises lawful processing and the protection of individuals’ digital personal data, with relevant provisions subject to their notified commencement schedule. 


37. Prohibited Uses

Customers must not use the website or JewelPatakha’s services to:

  • Commit fraud;
  • Place false orders;
  • Use stolen payment credentials;
  • Impersonate another person;
  • Introduce malware;
  • Attempt unauthorised access;
  • Scrape or extract data without permission;
  • Interfere with website security;
  • Submit false reviews;
  • Make fraudulent return claims;
  • Substitute returned products;
  • Harass customers or staff;
  • Violate intellectual-property rights;
  • Resell content without permission; or
  • Engage in unlawful activity.

JewelPatakha may suspend an account, cancel an order or restrict services where reasonably necessary to prevent fraud, misuse or unlawful conduct.

Mandatory consumer rights will remain unaffected.


38. Fraud and Abuse Prevention

JewelPatakha may review orders and accounts for indicators of:

  • Repeated COD refusal;
  • Chargeback abuse;
  • Product substitution;
  • False missing-item claims;
  • Altered evidence;
  • Unauthorised payment;
  • Multiple suspicious accounts;
  • Reseller activity disguised as retail purchasing; or
  • Other fraudulent behaviour.

Where credible evidence establishes misuse, JewelPatakha may:

  • Cancel an order;
  • Restrict COD;
  • Require prepaid payment;
  • Reject a discretionary return;
  • Suspend an account;
  • Preserve evidence; or
  • Take lawful action.

Genuine complaints will continue to be assessed fairly.


39. Bulk and Reseller Orders

These Terms are primarily intended for retail customers purchasing for personal use.

Bulk, reseller, stylist, commercial or corporate-gifting orders may be subject to separate written terms concerning:

  • Minimum quantities;
  • Wholesale pricing;
  • Advance payment;
  • Delivery;
  • Quality tolerance;
  • Cancellation;
  • Returns;
  • Branding;
  • Packaging; and
  • Intellectual-property use.

A person purchasing for resale should disclose that purpose before placing the order.

JewelPatakha may cancel or revise an order that appears to be a commercial order but was placed under retail terms.


40. Styling Information

JewelPatakha may provide general styling suggestions concerning:

  • Outfit combinations;
  • Occasion suitability;
  • Necklines;
  • Colour pairing;
  • Face shapes;
  • Layering; and
  • Jewellery coordination.

Styling advice is subjective and does not guarantee:

  • An identical appearance;
  • A perfect outfit match;
  • Comfort for every customer;
  • Social-media performance;
  • Compliments; or
  • A particular personal result.

Customers remain responsible for their final styling and purchase decision.


41. Third-Party Services and Links

The website may link to or use services provided by:

  • Razorpay;
  • Banks;
  • UPI providers;
  • Courier companies;
  • Instagram;
  • WhatsApp;
  • Analytics providers;
  • Hosting providers; and
  • Other external platforms.

Third-party services may be governed by their own terms and privacy policies.

JewelPatakha is not responsible for an independent third party’s website, content or processing, except to the extent JewelPatakha remains legally responsible for selecting or using a service provider in connection with its own obligations.


42. Website Availability

JewelPatakha aims to keep the website available and functional but does not guarantee uninterrupted access.

The website may be temporarily unavailable because of:

  • Maintenance;
  • Updates;
  • Hosting interruption;
  • Cybersecurity incidents;
  • Internet failure;
  • Payment-provider interruption;
  • Technical defects; or
  • Circumstances outside reasonable control.

JewelPatakha will make reasonable efforts to restore service and protect affected customers.


43. Website Security

Customers must not attempt to:

  • Test website vulnerabilities without permission;
  • Circumvent security;
  • Access restricted systems;
  • Upload harmful code;
  • Interfere with checkout;
  • Manipulate prices; or
  • Obtain another customer’s information.

Suspected unauthorised access may be reported to:

44. Disclaimer of Warranties

JewelPatakha will provide products in accordance with their applicable descriptions, policies and mandatory legal standards.

Except where expressly provided or required by law, JewelPatakha does not promise that:

  • Fashion-jewellery plating will never fade;
  • Products are hypoallergenic;
  • Products are suitable for continuous daily wear;
  • Every screen will display identical colours;
  • Every hand-finished piece will be perfectly identical;
  • The website will always be uninterrupted; or
  • Jewellery will match every customer’s personal expectation or outfit.

Nothing in this section excludes an express product commitment or a mandatory warranty or consumer right.


45. Limitation of Liability

To the maximum extent permitted by law, JewelPatakha will not be liable for indirect or consequential losses that were not reasonably foreseeable when the order was accepted, including losses arising solely from:

  • A customer ordering too close to an event;
  • Personal outfit mismatch;
  • Failure to follow product-care instructions;
  • Unauthorised repair;
  • Improper storage;
  • Customer-supplied incorrect information; or
  • Unlawful or unauthorised use of the website.

Where JewelPatakha is responsible for a confirmed product or service failure, an appropriate remedy may include:

  • Repair assistance;
  • Replacement;
  • Exchange;
  • Refund;
  • Re-performance of the relevant service; or
  • Another remedy required by law.

Nothing in these Terms excludes or limits liability for:

  • Fraud;
  • Wilful misconduct;
  • A misleading representation;
  • Defective or materially misdescribed goods;
  • Breach of a non-excludable statutory duty;
  • Product liability where legally established; or
  • Any liability that cannot lawfully be excluded.

46. Customer Responsibility and Indemnity

The customer may be responsible for direct loss reasonably caused by their unlawful use of the website, fraud, intentional misuse, infringement of JewelPatakha’s intellectual property or submission of content they had no right to use.

This provision will not require a consumer to indemnify JewelPatakha for:

  • JewelPatakha’s own fault;
  • A defective product;
  • A misleading statement;
  • A deficient service; or
  • Any liability that the law places upon JewelPatakha.

47. Force Majeure

JewelPatakha will not be treated as breaching these Terms to the extent performance is prevented or materially delayed by circumstances beyond reasonable control, including:

  • Natural disaster;
  • Flood or fire;
  • Epidemic;
  • War;
  • Civil disturbance;
  • Government restriction;
  • Transport shutdown;
  • Courier-network interruption;
  • Strike;
  • Electricity or internet failure;
  • Supplier shutdown; or
  • Similar extraordinary circumstances.

JewelPatakha will take reasonable steps to:

  • Inform affected customers;
  • Reduce the delay;
  • Resume performance;
  • Cancel an unfulfillable order; and
  • Refund amounts due for unfulfilled products.

48. Privacy

Personal information will be collected, used, stored and shared in accordance with JewelPatakha’s Privacy Policy and applicable law.

The Privacy Policy explains:

  • Information collected;
  • Order processing;
  • Payment and shipping disclosures;
  • Marketing choices;
  • Cookies;
  • Security;
  • Retention;
  • Customer rights; and
  • Privacy complaints.

Customers should review the Privacy Policy before placing an order.


49. Electronic Communications

By providing an email address or telephone number, the customer agrees to receive operational communications relating to:

  • Orders;
  • Payments;
  • COD verification;
  • Dispatch;
  • Delivery;
  • Returns;
  • Refunds;
  • Security; and
  • Customer support.

Promotional communications will be sent only where legally permitted and may be unsubscribed from.

Electronic notices may be considered received according to applicable law and the normal operation of the designated communication system. The Information Technology Act contains provisions addressing the dispatch and receipt of electronic records.

Consumer complaints will be acknowledged within 48 hours, and JewelPatakha will endeavour to resolve them within one month from receipt.

Customers may also approach the National Consumer Helpline, which operates as a Department of Consumer Affairs pre-litigation grievance mechanism through numbers including 1915 and 1800-11-4000 and its official digital channels. 


51. Governing Law

These Terms are governed by the laws of India.

Applicable laws may include, where relevant:

  • The Indian Contract Act, 1872;
  • The Information Technology Act, 2000;
  • The Consumer Protection Act, 2019;
  • The Consumer Protection (E-Commerce) Rules, 2020;
  • Applicable GST laws;
  • Applicable Legal Metrology requirements;
  • Applicable intellectual-property laws; and
  • Applicable privacy and data-protection requirements.

Nothing in these Terms removes a right granted to a customer under mandatory Indian law.


52. Dispute Resolution

Customers are encouraged to follow this sequence:

  1. Contact JewelPatakha customer care.
  2. Raise a formal grievance with the Grievance Officer.
  3. Request escalation to the proprietor.
  4. Use the National Consumer Helpline or another appropriate pre-litigation mechanism.
  5. Approach a competent consumer commission, court or authority where the dispute remains unresolved.

This internal process does not prevent a customer from exercising a legal remedy available under the Consumer Protection Act or another applicable law. The Consumer Protection Act provides for consumer dispute-redressal commissions and mechanisms for consumer complaints. 


53. Jurisdiction

Subject to mandatory consumer-protection jurisdiction and any right to file a complaint before another competent forum under applicable law, courts at Ahmedabad, Gujarat will have jurisdiction over disputes arising from these Terms.

This clause does not prevent a consumer from approaching a consumer commission or other authority having jurisdiction under applicable law.


54. Severability

If any provision of these Terms is held invalid or unenforceable:

  • The remaining provisions will continue to apply;
  • The affected provision will be interpreted as closely as lawfully possible to its intended purpose; and
  • Mandatory consumer rights will continue unaffected.

55. No Waiver

If JewelPatakha does not immediately enforce a provision, that does not mean it permanently waives the right to enforce it later.

A waiver will be effective only where clearly communicated by an authorised representative.


56. Assignment

Customers may not transfer an order, account or contractual right for commercial purposes without JewelPatakha’s written permission.

JewelPatakha may transfer its business rights and obligations as part of a lawful restructuring, sale or transfer, provided customer rights and applicable data-protection obligations remain protected.


57. Entire Agreement

These Terms, the relevant product page, order confirmation and incorporated policies constitute the agreement between JewelPatakha and the customer concerning the relevant order.

A separate written quotation, custom-order confirmation or bulk-order agreement may supplement or replace particular provisions for that transaction.


58. Changes to These Terms

JewelPatakha may update these Terms to reflect:

  • Changes in business operations;
  • New payment or delivery services;
  • New product categories;
  • Changes in policies;
  • Legal developments; or
  • Website improvements.

The revised Terms will be published with an updated “Last Updated” date.

Changes will not ordinarily reduce contractual or statutory rights that have already arisen from an accepted order.
